1. Acceptance of Terms

By using TradeTEST.TRAINING, you agree to these Terms of Service. If you do not agree, do not use this platform. We may update these terms from time to time. Your continued use after changes means you accept the updated terms.

2. Description of Service

TradeTEST.TRAINING is a practice exam software platform for California contractor licensing exams. We provide practice test questions, adaptive study tools, and exam simulations.

We are not a school, course provider, or accredited educational institution. We do not offer instruction, classes, or degrees. We provide practice test software only. This distinction is important under California Education Code Section 94874.

3. Account Terms

One account per person. You are responsible for keeping your password secure. Sharing your account with anyone else is not allowed. If we find multiple people using the same account, we may suspend or terminate that account.

4. Payment and Refunds

TradeTEST.TRAINING costs a one-time payment of $149 for Full Access or $49 for Test Prep Access. There are no subscriptions or recurring charges.

We offer a 30-day money-back guarantee from the date of purchase. If you are not satisfied, contact us within 30 days and we will issue a full refund within 5 business days. After 30 days, all sales are final.

5. Intellectual Property

All questions, answer options, explanations, study materials, diagrams, mnemonics, and learning content on this platform are original works owned by TradeTEST.TRAINING and protected by United States copyright law.

You may NOT:

  • Copy, reproduce, screenshot, photograph, download, scrape, crawl, or extract questions, answers, or explanations from this platform
  • Use automated tools, scripts, bots, browser extensions, or any other technology to systematically access or collect content
  • Manually copy content in bulk for any purpose, including personal study notes that reproduce our questions word-for-word
  • Share, distribute, sell, or publish any content from this platform
  • Create derivative works based on our questions or explanations
  • Use any content from this platform to train, fine-tune, or provide data to any artificial intelligence or machine learning model

6. Prohibited Conduct

  • No scraping, crawling, or automated access of any kind
  • No sharing your account credentials with others
  • No attempting to access the database, API, or backend systems beyond normal use of the platform
  • No reverse engineering the adaptive algorithm or question selection logic
  • No using the platform for any purpose other than personal exam preparation

7. Account Termination

We may terminate any account immediately and without refund if we reasonably believe the account is being used to copy, extract, scrape, or redistribute platform content. We may also terminate accounts for any violation of these terms.

8. Liquidated Damages

You agree that unauthorized reproduction of platform content causes harm that is difficult to calculate. If you reproduce, distribute, or publish any content from this platform without our written permission, you agree to pay liquidated damages of $50 per question or content item reproduced, in addition to any statutory damages available under U.S. copyright law (17 U.S.C. § 504).

9. DMCA and Copyright Complaints

If you believe content on this platform infringes your copyright, send us a DMCA takedown notice with the following information:

  • Your contact information
  • Identification of the copyrighted work
  • Identification of the infringing material and its location on our platform
  • A statement of good faith belief that the use is not authorized
  • A statement under penalty of perjury that the information is accurate and you are the copyright owner or authorized to act on their behalf
  • Your physical or electronic signature

10. Billing Descriptor

Charges from TradeTEST.TRAINING will appear on your credit card or bank statement as “TRADETEST.TRAINING” or “TRADE TEST TRAINING” or similar. If you do not recognize a charge, please contact us before disputing with your bank. We resolve billing questions within 1 business day.

11. Dispute Resolution

Before filing any legal claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days. If we cannot resolve the dispute informally, either party may proceed to binding arbitration administered by JAMS in Alameda County, California, under its Streamlined Arbitration Rules. The arbitrator’s decision is final and enforceable in any court. You agree to arbitrate disputes individually and waive any right to participate in a class action.

Small claims court: Either party may bring claims in small claims court in Alameda County, California, if the claim qualifies.

12. Disclaimer

This platform is practice test software. We do not guarantee you will pass the CSLB exam. Your results depend on your individual study effort, experience, and preparation. We are not affiliated with, endorsed by, or connected to the Contractors State License Board (CSLB).

13. Limitation of Liability

TradeTEST.TRAINING is provided “as is” without warranty of any kind. Our total liability to you for any claim arising from your use of this platform is limited to the amount you actually paid us (up to $149). We are not liable for indirect, incidental, or consequential damages.

14. Governing Law

These terms are governed by the laws of the State of California. Any disputes will be resolved in the state or federal courts located in Alameda County, California.

15. Changes to Terms

We may update these terms at any time. When we do, we will update the “Last updated” date at the top of this page. Your continued use of the platform after any changes means you accept the new terms.
